16 Bars TV respects the intellectual property rights of others. In accordance with the Digital Millennium Copyright Act (“DMCA”), 17 U.S.C. § 512, the following policy describes how to submit a notice of claimed copyright infringement.

1. Submitting a Notice of Infringement

To submit a notice under the DMCA, send a written communication to the Designated Copyright Agent above that includes:

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
  2. Identification of the copyrighted work claimed to have been infringed;
  3. Identification of the material claimed to be infringing, with information reasonably sufficient to permit us to locate the material (such as the URL on the Site);
  4. Information reasonably sufficient to permit us to contact you, including your address, telephone number, and email;
  5. A statement that you have a good-faith belief that the use of the material is not authorized;
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner.

Knowingly making a material misrepresentation in a DMCA notice may result in liability under 17 U.S.C. § 512(f).

2. Counter-Notification

If material you submitted has been removed and you believe it was removed in error, you may submit a counter-notification under 17 U.S.C. § 512(g) that includes your signature, identification of the material, a statement under penalty of perjury that you have a good-faith belief that the material was removed as a result of mistake or misidentification, and your name, address, telephone number, and a statement that you consent to the jurisdiction of the U.S. District Court for the Eastern District of North Carolina.

3. Repeat Infringer Policy

We will, in appropriate circumstances, terminate the access of users who are repeat infringers.
